Yesterday, January 17, the Declaration of Public Utility was published in the Official Gazette of the Federation (DOF), through which the Secretary of Agrarian, Territorial and Urban Development (Sedatu), Román Guillermo Meyer Falcón, formalizes the expropriation of 2.4 million square meters (240 hectares) of private property in the municipalities of Benito Juárez (Cancún), Puerto Morelos and Solidaridad for Section 5 north of the Mayan Train.

Prior to this declaration, changes were announced in Section 5 north (Cancún-Playa del Carmen) and Section 5 south (Playa del Carmen-Tulum), which are the ones that originate the acquisition of land for new rights of way and other necessary infrastructure. for the Mayan Train.

The document lists the cadastral accounts and the dimensions of each of the 198 privately owned properties that will be expropriated by the federal government, of which 22 are in Benito Juárez, 142 in Solidaridad and 34 in Puerto Morelos.

It is ensured that “the cause of public utility provided for in article 1, section III Bis of the Expropriation Law is complied with, since (the Mayan Train) is a public infrastructure work, whose purpose is to meet and satisfy the needs of the population in general, both for tourists and for the inhabitants of the localities located within the Yucatan Peninsula”.

The declaration establishes that the owners of the land will have a period of 15 business days from the notification or the second publication in the DOF to express what is convenient for their right and interest and present the evidence to prove their right.

They also anticipate that they will proceed “to the immediate occupation of the properties involved, prior agreement with the owners of the same, in accordance with article 9 Bis section III of the Expropriation Law”.


At the end of November 2021, the former general director of the National Fund for the Promotion of Tourism (Fonatur), Rogelio Jiménez Pons, informed El Economista about a new change in the layout of Section 5 north of the Mayan Train, which implies that the track will run alongside the highway, on the side of the high-tension lines of the Federal Electricity Commission (CFE), parallel to highway 307 (Cancún-Tulum), in addition to another “interior” section on which they will have to acquire new rights of way for the project.

Until before this change, the announced layout placed the road on a second elevated floor in the center of Highway 307, from Playa del Carmen to Cancun International Airport.

The change implies that approximately at the height of Puerto Morelos, halfway between Playa del Carmen and Cancun, the road leaves the center of the highway and runs for about 20 kilometers alongside the highway, on the side of the high-speed lines. tension of the CFE, in addition to another “interior” section through the ejido Alfredo V. Bonfil, to the train station that will be located behind the Cancun air terminal, that is, around 27 kilometers of new line, no longer elevated, but at ground level.

Jiménez Pons announced since then that this change implied for Fonatur to acquire new rights of way, in addition to the fact that the change is due to the severe problems in the subsoil of the highway section that is located at the exit of Cancún, for which the new route will allow them avoid that area.

The details of the other agreement that the Secretary of the Interior, Adán Augusto López Hernández, was supposed to reach with the hotel businessmen and other private landowners in Section 5 south (Playa del Carmen-Tulum), for the that Sedatu also sent announcements of expropriation between October and November of last year that generated disagreement among the hoteliers of the Riviera Maya.

The tension generated led to another change of layout in Section 5 South, which also involves removing the track from the center of Highway 307 to move it to the side where the CFE’s high-voltage tracks run, although many businessmen also have properties and infrastructure there. complementary to its hotels.

Before leaving office, Jiménez Pons said that the acquisition of land for this new stretch of Section 5 South would imply an expense of around 1,000 million pesos for the federal government. In these negotiations it has not been specified whether the hoteliers are intended to voluntarily sell their land or if they will only facilitate the negotiations so that part of their land is also expropriated.

Other modifications

In September of last year, Fonatur announced that the road would no longer pass through the center of the city of Campeche to avoid possible relocation of homes, and protection by the population, as there were protests and even the train tracks were taken to avoid the progress of the works.

Just a few days later, Fonatur announced that the train would not reach the area known as La Plancha, in the center of Mérida, but instead would move to the Teya area.

“For the moment, it has been decided not to start the construction of the La Plancha station. It is contemplated that the railway system station for the city will be located in the Teya area. Such determination was made based on an analysis whose results show that in order to make the construction time of the project more efficient, it was necessary to modify the route, since problems in terms of construction and mobility within the city must be avoided,” it was detailed in a statement. .
